Understanding Road Accident Claims

We handle a variety of road accident claims:

  • Car, truck and motorcycle accidents
  • Public transport accidents including buses, trains and trams
  • Bicycle accidents involving vehicles or road conditions
  • Pedestrian injuries
  • Single vehicle accidents caused by road defects or hazards

Our Approach to TAC Claims

When you’re dealing with injuries, medical treatment and recovery, it can be overwhelming to navigate the TAC system and fight for your full entitlements.

Fighting for the rights of motorists, passengers, pedestrians and cyclists alike, we have a proven track record of obtaining maximum compensation for victims of road and transport accidents.

We approach negotiations with the TAC as if we were going to court, using barristers who have years of experience, and with a clear picture in mind of the compensation range we want to secure on your behalf.

We work to get the best results for our clients while making the entire process as fast, easy and stress-free as possible. That’s why the vast majority of our claims are settled long before the prospect of going to court.

No Win, No Fee OR Expenses Legal Services

We understand the financial strain of being injured in a road accident, and ensure that should we not achieve a successful outcome, you won’t be left out of pocket, guaranteeing to cover you for any expenses or disbursements that we incur.

FAQs

  • Who can make a TAC claim?

You can make a TAC claim if you, or someone you represent, was involved in an accident caused by a motor vehicle, motorcycle, bus, train or tram in Victoria.

    • This includes drivers, passengers, pedestrians, cyclists and motorcyclists injured in transport accidents.
    • You don’t need to be at fault to claim. The TAC is a ‘no-fault’ insurance scheme owned by the Victorian Government.
    • If a loved one was killed in a transport accident, their dependents and family members may also be eligible to claim for funeral expenses and financial support.
  • Is there a time limit on TAC claims?

Yes. A TAC claim must be lodged within 12 months of your accident for immediate medical and other benefits.

    • For common law damages (a lump sum payment for serious injuries), you generally have three years from the accident date.
    • It’s critical to notify the TAC as soon as possible after your accident to ensure you don’t miss important deadlines and can access treatment and support right away.

If you’re unsure whether you’re within the time limits, contact us immediately. We’ll be able to assess your situation and advise on your options.

  • What can I claim with a TAC case?

Your TAC claim may entitle you to coverage for:

    • Medical treatment and services
    • Income support if you’re unable to work as a result of the accident
    • Return to work support
    • Replacement or repair of damaged glasses or dentures
    • A lump sum payment
    • Medical Treatment visa application fees if required
  • How much TAC compensation can I receive?

The type and amount of support you receive depends on your individual circumstances, the severity of your injuries, how the accident has impacted your ability to work and enjoy life and your ongoing medical and care needs.

    • Weekly income payments are calculated based on your pre-accident earnings
    • Lump sum payments for serious injuries can be substantial
    • Medical and treatment costs are covered in full for approved services

During your free consultation, we’ll assess your situation, explain what compensation you may be entitled to.
