Shoulder injury (Work-related injury)
45 year old man suffered a shoulder injury at work that required him to undergo arthroscopic surgery. He was employed by a company who are self-insured for WorkCover. The client was able to return to new employment on a full-time basis after his shoulder surgery. The worker resolved his case for $130,000.
Back injury (motor vehicle accident whilst working as a truck driver)
53 year old man working as a truck driver. Employed by a Victorian company but undertook interstate driving. Truck rolled on a privately owned railway in the course of a delivery by our client resulting in lower back injury and an arm fracture. The arm healed well, but the back remained problematic and affected our client’s ability to keep working as an interstate driver. Some work was still able to be undertaken, but not long interstate driving. Court proceedings were issued, but the matter settled before proceeding in Court for $440,000.
Neck Injury (motor vehicle accident)
62 year old woman suffered injury to her neck when she was driving and was rear ended by another vehicle. She had pre-existing neck ache and chiropractic treatment. She was working full time at the time of the accident but had to reduce to part-time work after the accident due to the neck injury. The case settled by way of negotiation with the TAC for $395,000.
Back injury (Work-related injury)
55 year old man who sustained a lower back injury requiring back surgery (fusion) in 2009. He made an excellent recovery and returned to work. Approximately 8 years later, he suffered a further serious injury to his back while he was at work and consequently he was forced to stop work. A lot of work was put into the case to establish that even with a prior back injury, he would have been able to continue in his job had he not had the second, serious injury to his back. The case resolved prior to issuing court proceedings as WorkSafe accepted our client’s offer of $650,000 for pain and suffering and loss of earnings.
Shoulder injury (Work-related injury)
49 year old man who suffered a non dominant shoulder injury resulting in surgery (an arthroscopy.) Employed by a company who are self insured for WorkCover. The case resolved for $325,000. This was a case where we (the lawyers) recommended to our client that he proceed further with his claim as we thought we could achieve a higher result. Our client was adamant he wanted to resolve the case and was very happy with the outcome.
