Some of our Geelong client wins

Back Injury (Work-related injury)

43 year old man who suffered a lower back disc prolapse resulting in surgery as a result of heavy and repetitive lifting and moving animal carcasses over time in his work as a labourer/butcher. To his credit our client was able to obtain part time alternative employment after his injury. WorkSafe refused to accept that despite his efforts to obtain work, our client continued to suffer economic loss. The matter ultimately settled at the door of the Court for $375,000 for both pain and suffering and economic loss damages.

This case was expertly handled by Simone Welsh, Accredited Personal Injury Specialist from our Geelong office.

Shoulder injury (Injury in a public place)

63 year old woman who suffered a fractured humerus in a public place resulting in emergency surgery. She had 3 months off work. She has ongoing restrictions in her shoulder and is working modified duties. This case settled for $290,000 for pain and suffering and medical expenses.

This case was expertly handled by Jodie Harris, Partner from our Geelong office.

Psychiatric injury (Work-related injury)

56 year old man who suffered a severe psychiatric injury as a result of being bullied by a manager at his workplace. He was able to return to work as a self-employed home handyman where he could pick and choose his hours and avoid the stress of dealing with management. Despite some pre-trial offers to grant our client a serious injury certificate, no settlement offers were forthcoming and the matter proceeded to hearing in the County Court for both pain and suffering and economic loss damages. Our client gave credible and straightforward evidence which put pressure on the defendant to make an offer of settlement prior to the Judge handing down her decision. The case resolved for $120,000 for pain and suffering damages.

This case was expertly handled by Simone Welsh, Accredited Personal Injury Specialist from our Geelong office.

Knee injuries (work injury)

61 year old man who suffered injuries over time in his job as a carpet layer. His claim was lodged and accepted 9 years ago. He received WorkCover payments for two and a half years (130 weeks) and then the WorkCover insurer terminated his payments on the basis that he could go back to suitable work. Thereafter he received social security benefits. Five years after his WorkCover weekly payments were terminated he came to us for advice. Court proceedings were issued and were successful in getting him back on WorkCover weekly payments and back pay of those payments for all the years when they were not paying him.

This case was expertly handled by Jodie Harris, Partner from our Geelong office.

Psychiatric injury (Work-related injury)

57 year old man who suffered a severe psychiatric injury in a terrifying workplace accident.  He had been able to return to work in a limited capacity but could never return to employment where the accident happened. This case was fully prepared and ready to proceed in Court as no offers had been made by the two companies who we say were responsible for the accident. The case resolved for $750,000 just before it was due to commence in Court before a jury.

This case was expertly handled by Leon Raneri from our Geelong office.

Shoulder and neck injury (Work-related injury)

52 year old woman who suffered injuries to her right shoulder and neck as a result of repetitively reaching above head height in her work as a picker/packer for a clothing manufacturer. She had multiple surgeries for her condition, ketamine infusion and a failed trial of a spinal cord stimulator. Our client’s injuries were debilitating, and she was not able to return to any form of employment. WorkSafe initially refused to make any offers in the case, but ultimately agreed to pay $265,000 to our client for both pain and suffering and economic loss damages shortly prior to Court proceedings being issued.

This case was expertly handled by Simone Welsh, Accredited Personal Injury Specialist from our Geelong office.
