Right shoulder injury (work related injury)

48-year-old woman who suffered a significant right shoulder injury requiring surgical intervention and complicated by the development of frozen shoulder syndrome. The case resolved for $500,000 just prior to the hearing, and well above the amount offered by the insurer at the early stages. The client was very pleased with the result.

Psychiatric injury (Work-related injury)

56 year old man who suffered a severe psychiatric injury as a result of being bullied by a manager at his workplace. He was able to return to work as a self-employed home handyman where he could pick and choose his hours and avoid the stress of dealing with management. Despite some pre-trial offers to grant our client a serious injury certificate, no settlement offers were forthcoming and the matter proceeded to hearing in the County Court for both pain and suffering and economic loss damages. Our client gave credible and straightforward evidence which put pressure on the defendant to make an offer of settlement prior to the Judge handing down her decision. The case resolved for $120,000 for pain and suffering damages.

Shoulder and neck injury (Work-related injury)

52 year old woman who suffered injuries to her right shoulder and neck as a result of repetitively reaching above head height in her work as a picker/packer for a clothing manufacturer. She had multiple surgeries for her condition, ketamine infusion and a failed trial of a spinal cord stimulator. Our client’s injuries were debilitating, and she was not able to return to any form of employment. WorkSafe initially refused to make any offers in the case, but ultimately agreed to pay $265,000 to our client for both pain and suffering and economic loss damages shortly prior to Court proceedings being issued.

Knee injuries (work injury)

61 year old man who suffered injuries over time in his job as a carpet layer. His claim was lodged and accepted 9 years ago. He received WorkCover payments for two and a half years (130 weeks) and then the WorkCover insurer terminated his payments on the basis that he could go back to suitable work. Thereafter he received social security benefits. Five years after his WorkCover weekly payments were terminated he came to us for advice. Court proceedings were issued and were successful in getting him back on WorkCover weekly payments and back pay of those payments for all the years when they were not paying him.

Shoulder injury and thoracic outlet syndrome (Work-related injury)

29 year old woman who suffered an injury affecting dominant upper limb, namely thoracic outlet syndrome. She had surgery for her condition, and all of her medical information indicated she had made an excellent recovery after the surgery. WorkSafe refused to make any offers in the case and the matter proceeded to hearing before a Judge where a judgment of $140,000 for pain and suffering was achieved.
