Bullying is an increasing problem within the workplace. There is a range of legal protections about which we can advise clients who find themselves harassed. There are various legal jurisdictions under which allegations of bullying harassment can be pursued and prosecuted. Bullying and harassment can also sometimes involve breaches of other legislation, such as equal opportunity or whistle blowing laws.
Under the Fair Work Act, workers who have been bullied at work are able to apply to the Fair Work Commission for an order to stop the bullying.
We also help employees who have been dismissed or treated unlawfully during employment to lodge general protections claims. The general protections provisions are contained in the Fair Work Act, and also offer safeguards to employees, including those who have been discriminated against at work or who have suffered adverse action for exercising their workplace rights.
